- THESE TERMS
These terms apply when you use combatcellar.com or purchase goods from us.
Please read these terms alongside our Shipping Policy, Returns Policy and Privacy Policy. Nothing in these terms affects your statutory rights under UK consumer law.
- USING OUR WEBSITE
You must use our website only for lawful purposes. You must not attempt to damage the website, introduce malicious software, gain unauthorised access or interfere with its operation.
We may update, suspend or withdraw parts of the website where reasonably necessary. We cannot guarantee that the website will always be available without interruption.
- PRODUCTS AND DESCRIPTIONS
We take reasonable care to ensure that product descriptions, photographs, prices and availability information are accurate.
Colours and appearance may vary slightly because of lighting, photography and different screen settings. Measurements are approximate unless stated otherwise.
Military surplus and other used products may show signs of previous use, storage, repairs, fading or wear. Any significant known defects will be described where reasonably possible. These characteristics do not affect your statutory rights where an item is faulty or materially different from its description.
- AGE-RESTRICTED PRODUCTS
You must meet the applicable legal age requirement to purchase an age-restricted product.
You must be aged 18 or over to purchase an imitation firearm, including a two-tone airsoft gun or realistic imitation firearm.
The sale of a realistic imitation firearm also requires evidence that a permitted purpose or legal defence applies. We may request identification, UKARA details or other supporting evidence before completing an order.
We may use age-verification checks, request photographic identification or require age verification on delivery where appropriate. We reserve the right to refuse or cancel an order if we cannot complete the necessary checks.
Providing false age, identity or defence information may result in cancellation of the order and could be reported to the appropriate authorities.
- ORDERS
Placing an order constitutes an offer to purchase the selected goods.
An automated order confirmation acknowledges that we have received your order but does not necessarily mean that the order has been accepted. A contract is formed when we confirm dispatch, unless we have expressly accepted the order earlier.
We may refuse or cancel an order where:
• A product is unavailable
• Pricing or product information contains an obvious error
• Payment cannot be authorised
• We suspect fraud or unlawful activity
• Legal or age-verification requirements have not been met
• Delivery restrictions prevent us from fulfilling the order
If payment has already been taken for an order we cannot fulfil, we will issue a refund.
- PRICES AND PAYMENT
Prices are displayed in pounds sterling and include VAT where applicable.
Delivery charges and available services are shown at checkout before payment. Prices may change, but changes will not affect an order we have already accepted.
You must provide complete and accurate payment, billing and delivery information.
- DELIVERY
We aim to dispatch orders within the times stated in our Shipping Policy. Delivery estimates are not guaranteed where delays arise outside our reasonable control.
Responsibility for the goods passes to you when they are delivered to you or to a person identified by you to receive them.
Please see our Shipping Policy for further information about dispatch, delivery charges and tracking.
- CANCELLATIONS AND RETURNS
If you purchase online, you will normally have the right to cancel your order within 14 days after receiving the goods, without providing a reason.
After notifying us that you wish to cancel, you normally have a further 14 days to return the goods.
Certain goods may be exempt from change-of-mind cancellation rights, including:
• Personalised or custom-made products
• Sealed products that cannot be returned for health or hygiene reasons once unsealed
• Perishable products
• Other products excluded under applicable consumer legislation
These exceptions do not remove your rights where goods are faulty, damaged or not as described.
Please refer to our Returns Policy for instructions and further details.
- FAULTY OR MISDESCRIBED GOODS
Goods must be as described, of satisfactory quality and fit for their intended purpose where applicable.
If an item is faulty, damaged or materially different from its description, please contact us as soon as possible. We will handle the matter in accordance with the Consumer Rights Act 2015 and other applicable consumer legislation.
Nothing in these terms restricts your legal rights to a repair, replacement, price reduction or refund where those rights apply.
- PERSONALISED PRODUCTS
You are responsible for checking names, wording, artwork, sizes, colours and other details supplied for personalised or printed products.
We are not responsible for errors contained in information or artwork approved or supplied by you. This does not exclude responsibility for mistakes made by us or for faulty workmanship.
You confirm that you have permission to use any logo, image, trademark or other material supplied to us. You are responsible for claims resulting from material supplied without the necessary permission.
- SAFE AND LAWFUL USE
Products must be used responsibly, safely and in accordance with UK law.
Airsoft guns and imitation firearms must not be carried or displayed in public without lawful authority or a reasonable excuse. They should be transported securely, covered and out of sight.
You are responsible for checking that purchasing, possessing, transporting and using a product is lawful in your location and circumstances.
- OUR LIABILITY
We do not exclude or limit liability where it would be unlawful to do so. This includes liability for:
• Death or personal injury caused by our negligence
• Fraud or fraudulent misrepresentation
• Breach of your statutory consumer rights
• Any other liability that cannot legally be excluded
We are not responsible for losses that were not reasonably foreseeable when the contract was formed or that result from your misuse, unlawful use or alteration of a product.
Products purchased as a consumer are supplied for private use. If you use a product for commercial purposes, we will not be responsible, to the extent permitted by law, for loss of profit, revenue, business, contracts or commercial opportunities.
- THIRD-PARTY SERVICES AND LINKS
Our website may contain links to websites or services operated by third parties. We are not responsible for their content, availability, security or privacy practices.
Payment, delivery and other services may be supplied by third-party providers subject to their own applicable terms.
- INTELLECTUAL PROPERTY
The content of this website, including text, photographs, graphics, branding and designs, belongs to Combat Cellar or is used with permission.
You may view and print website content for personal, non-commercial use. You must not reproduce, distribute or commercially exploit it without permission.
- PERSONAL INFORMATION
We process personal information in accordance with our Privacy Policy and applicable UK data-protection law.
Information supplied for age or legal-defence verification will be handled only for appropriate business, legal, fraud-prevention and record-keeping purposes.
- CHANGES TO THESE TERMS
We may update these terms to reflect changes in the law, our products or the operation of our website.
The terms applying to an order will normally be those published when the order was placed, unless a change is required by law.
- SEVERABILITY
If any part of these terms is found to be unlawful or unenforceable, the remaining provisions will continue to apply.
- GOVERNING LAW
These terms are governed by the laws of England and Wales.
If you live in Scotland or Northern Ireland, you retain the benefit of any mandatory consumer protections that apply where you live and may bring proceedings in your local courts where the law permits.
